Clients Of Suspended Real Estate Agents Free To Hire New Agents

It's not like this all happened overnight, it's been ongoing for nearly a year. I'll let you draw your own conclusions based on these facts:



Interesting that on 8/13/09 HRE Vanpor, Inc was created - at the same address as Hellickson Real Estate - 1014 North Street, Sumner, WA (see lease confirmation here: http://www.djc.com/re/leases.html?action=get&id=32491 )



Then, on 8/25/09 HRE Vanpor, Inc receives it's license as a Real Estate Firm in Washington: https://fortress.wa.gov/dol/dolprod/bpdLicenseQuery/lqsLicenseDetail.aspx?SessID=13136&RefID=47818



Then, barely 3 months later, on 11/12/09 the initial complaint was filed that seems to have started this process:

Oregon? I thought Hellickson wasn't licensed in Oregon?

Why is that significant you ask? And who is this guy?

Fred Erlenbusch is the Vice President of HRE Vanpor Inc!

According to the original news story broke on 9/8/10 KIRO TV indicates that "Before Michael and Tara Hellickson's web site was suddenly pulled down, it boasted that the Pierce County couple are the #1 real estate agents in Washington, Oregon and Hawaii. But according to Department of Licensing documents obtained Wednesday by KIRO 7, neither Hellickson has ever been licensed to sell real estate in Oregon or Hawaii."

Interestingly enough, Mr. Erlenbusch was just granted his real estate license in Hawaii on June 24, 2010 according to these hawaii.gov Real Estate Commission meeting minutes:

It appears that maybe it is actually Mr. Erlenbusch who is the real "#1 real estate agent in Washington, Oregon and Hawaii".... and not Michael Hellickson.





It'd be interesting to know if either Hellickson or one of their entities is an officer or board member or simply an employee or sub-contractor of HRE Vanpor Inc, however the Secretary of State feels we need to pay for this information:

SEATTLE -- Former clients of two local high-powered real estate agents whose licenses have been suspended are now free to hire new agents, KIRO 7 Consumer Investigator Amy Clancy has learned.

Michael and Tara Hellickson's listings were pulled from the market when the state Department of Licensing suspended their licenses last week because of alleged wrongdoing, mostly during short sales.

The couple's lawyer has filed a motion to get their suspended licenses back. But for now, they can't sell or buy real estate.

Michael Hellickson, a local real estate leader and self-proclaimed short sale expert, told KIRO 7 Consumer Investigators that he had more than 500 clients with homes for sale.

When his and his wife Tara's real estate licenses were suspended by the Department of Licensing last Friday for alleged wrongdoing, those listings were pulled.

Brad Bouma of Puyallup is just one of many who said he needs to sell his home or face financial ruin.

"My house just can't be sold right now. I've got a serious problem now," Bouma said.

Bouma had signed a contract with Hellickson to sell his home.

He, along with many other clients who contacted KIRO 7, wondered whether those contracts still stand now that the Hellicksons are unlicensed.

On Thursday, the DOL suggested the clients hire attorneys to get some answers.

But Friday, the Hellicksons' lawyer said that every one of those clients is free to hire another real estate agent, with no future share of the profits owed to the Hellicksons.

"Those contracts are void at this time because as soon as a license is suspended or revoked then any listing agreement that may have been entered is automatically void by operation of law, so they don't need any releases; they don't need Hellickson to do anything," said Doug Tingvall, the couple's attorney.

Doug Tingvall believes the state is unfairly targeting the Hellicksons. He and his clients call the DOL suspension a "witch hunt."

The state vehemently denies that.

"The department doesn't engage in witch hunts, the department's goal is to protect the public," said Jody Lee Campbell of the state Attorney General's Office. "The egregiousness of the violations here and their breadth, how many people they were effecting, necessitated immediate action."

The state said that in the long run, it hopes to make sure the Hellicksons lose their licenses permanently.

But if they do get them back, their attorney said that any client who hires someone else to do their real estate deal can stay with the new agent if they want. There's no longer any obligation concerning the Hellicksons.
